The following items are specifically not warranted:
- Defects in appliances or equipment which are covered under a manufacturers
warranty. These Warranties are passed on to you directly. Please follow
manufacturer's procedures for service.
- Defects in or caused by materials supplied or workmanship performed
by parties other than the Joseph Lane Company, Inc., their employees,
or subcontractors, under direct contract with the Joseph Lane Company,
Inc. for that specified work.
- Insect damage, damage from animals, damage from the elements, or acts
of God.
- Sod, trees, shrubs, and plants are specifically not warranted. This
includes sod, trees, shrubs, etc. existing prior to construction. It
is extremely important to keep new sod wet for the first month.
- Variations in pattern or color of wood grains and other natural products.
- Defects which are a result of natural characteristics of materials
such as, but not limited to, warping, cupping, twisting, or bowing of
wood, efflorescence (chalking ) of concrete, etc.
- Condensation and frost are specifically not warrant able conditions.
- Floor squeaks, minor drywall cracks, molding separations, etc. due
to the drying out process of the home.
- Discoloration in brick, paint, wood, mortar, caulk, concrete stucco,
shingles, carpet, porcelain, Formica, vinyl, plumbing & light fixtures,
tile, etc. due to neglect, staining, repairs, age, fading, dust, dirt,
rain, and other elements of nature.
- Color matches on paint touch ups are specifically not warranted.
- Cracking, flaking, shifting, or pitting of concrete or mortar due
to natural causes or neglect.
- Cracking, peeling, settling, etc. of caulk or grout due to natural
causes or neglect.
- Toilets or other plumbing that is "stopped up" by non-construction
related material such as diapers, etc.
- Broken water lines as a result of frozen sill cocks (outside faucets).
- Sump pump systems.
- Damage from a change in grade or landscaping by anyone other than
the Joseph Lane Company, Inc.. Failure of home owner to maintain original
grade.
- Consequential, incidental, or secondary damages, Loss of use . loss
of opportunity, loss of market, or rental value.
- Damage or loss that is caused by, or made worse by, failure to give
notice with in a reasonable time period (next business day).
- Loss or damage externally caused, including, but not limited to; acts
of God, (riot pr civil commotion, windstorm, fire, explosion, smoke,
water, hail, lighting, falling trees, or other objects, aircraft, vehicles,
flood, mud slides, earthquakes, volcanic eruption, radon, or other gases,
abuse or use of the home, or any part thereof, beyond the reasonable
capacity of such part for such use, or by any other external cause).
- Septic tanks
- Changes of the underground water table.
- Defects in outbuildings, including detached garages and detached carports,
and any improvements that were not a part of the original sale of the
home. Swimming pools and other recreational facilities, driveways, walkways,
patios decks, boundary walls, retaining walls and bulkheads and fences.
- Bodily or personal injury of any kind (including physical or mental
pain and suffering and emotional distress), medical, hospital, rehabilitation
or other incidental expenses, damage to personal property, or damage
to any property of others.
- 1tems noted on the closing walk through will be covered under the
normal terms of the Limited Warranty, providing the Joseph Lane Company,
Inc. has received notice from the homeowner that the items have been
completed.
- Loss or damage caused by abnormal loading on floors which exceed design
load as mandated by codes.
- Normal wear and tear or normal deterioration.
- Loss or damage caused by seepage of water.
- Cost of shelter, transportation, food, moving, storage, or other expenses
related to inconvenience or relocation during repairs.
- Exterior wood decks and all exterior hand railings are not covered
under this warranty.
- All light bulbs in the interior and exterior of the home.
- Structural defects
- Should any provision of this warranty be deemed unenforceable by any
court, the remaining provision shall remain in effect.
