The following procedures are outlined for your guidance to ensure orderly and systematic handling of your service requests. Your cooperation with these procedures will facilitate fast and efficient service for you. Defects appearing within the first sixty (60) days after the commencement date should be included in one (1) written request and delivered to Joseph Lane Signature Homes not later than seventy (70) days after the commencement date (except for emergencies). Mail in your list at the appropriate times and inspections will be scheduled with you. All request must be in writing. Notice must be received during the applicable warranty period. Our mailing address is PO Box 317, Liberty, MO 64069. Our phone number is 816-547-8300 between 8:00 AM to 5:00 PM, Monday through Friday. The proper forms to make request can be found in the back of this booklet. This is a One Year Limited Warranty and shall only cover warranted items for which a defect has appeared and discovered within one (1) year commencement date. Subject to the exceptions and exclusions described herein, it is warranted that the home will be free from defects in materials and workmanship. Non-Emergency items will not be addressed between scheduled inspections. All service inquiries must be made in writing. Only items identified as being warrant able defects will be listed for repair or replacement. Warrant able defects are defined by this warranty. You must make your home available during normal working hours (8:00 AM - 5:00 PM, Monday through Friday) For scheduling of warranty repairs and inspections. Appropriate repairs will be made within ninety ((90)) days after receipt of the written notice. As scheduling of several subcontractors can be very difficult, if you cancel or do not make your home available or a scheduled appointment, completion of that scheduled repair is specifically not guaranteed. In case of emergency the homeowner must mitigate the problem immediately. Consequential, incidental, or secondary damages are specifically not covered. We recommend homeowners insurance is purchased. Your Home Owner's Protection Plan does not cover ordinary wear and tear, abuse, neglect or lack of general maintenance connected with home ownership. Home warranties are designed to address mechanical defects that may arise. This warranty is not transferable. Any obligation under it terminates if the property is resold or ceases to be occupied by the homeowner to whom it was originally issued. For any problem covered by this Warranty, the Joseph Lane Company, Inc. in its sole discretion may repair, replace, or pay the Home Owner the reasonable cost of repairing or replacing, the defective item. Notwithstanding anything else contained herein, the Joseph Lane Company, Inc.'s total liability for deficiencies under its Limited Warranty is limited to the purchase price of the home. Steps taken to correct defects shall not act to extend the term of this Warranty. If the Joseph Lane Company, Inc. repairs or replaces, or pays the reasonable cost of repairing or replacing, any defect covered by this Warranty which is covered by any other insurance or warranty, the Home Owner must, upon request by the Joseph Lane Company, Inc., assign the proceeds of such insurance or the rights under such warranties to the Joseph Lane Company, Inc. to the extent of the cost to the Joseph Lane Company, Inc. of such repair, replacement or payment. Manufactures Warranties: Manufacturers warranties are hereby assigned to the owner. Any rights of the owner under those warranties are provided by the manufacture. 'Me Joseph Lane Company, Inc. does not assume any obligations under those manufacturer's warranties and no warranty coverage of items covered by manufacturer's warranties is provided. If a specific defect is not addressed in this booklet the following standards will be used to determine the obligations of the Joseph Lane Company, Inc.: Locally adopted codes, model codes covering the Joseph Lane Company, Inc., plumbing, and electrical systems or state and federal codes.
